A spokesman said the embargo, under which pilots has refused to fly any plane carrying hazardous cargo, was honored by several airlines and shippers.

The ruling was made by U.S. District Judge Henry F. Werker in dismissing a loan-sharking indictment against Philip Crispino handed up in October.

The indictment charging Crispino, a bus driver from Long Beach, L.I., also named as a co-defendant Ralph Jacobson, who was formerly accused of gunning down a Queens night-club owner who had appeared before a grand jury investigating organized crime. Charles E. Padgett was the strike force attorney who presented Crispino's case to -a federal grand jury. Werker said, though, Padgett was not properly authorized" to do so. Padgett also was the strike force attorney who helped present evidence that resulted in an indictment against Mario Gigante, the brother of Councilman Louis R.

Gigante and a' reputed member of the Vito Genovese crime family. Gigante was indicted last month on charges of heading a -county gambling ring that grossed $50 million a year. On hearing of Werker's ruling, Gigante's attorneys also filed for the dismissal of his indictment. A Bold Assertion The letter that commissioned Padgett to the strike force was sent by the U.S. Attorney General's office.

Werker said that letter was not "sufficiently I specific" as to what Padgett was to investigate, but rather "a bold assertion of authority by the Attorney General." Letters similar to the one commissioning Padgett to the strike force have been sent out since 1972. As a result, Werker's ruling would apply to all 12 special strike force attorneys now investigating organized crime in Manhattan, the Bronx and some nearby suburbs. Between them, the 12 special attorneys have represented the government before grand juries that have returned about 30 indictments, all of which are now in jeopardy of being dismissed.
